You may be upset about the way that you have been treated under a deceased person’s will.

It may be that you have been left out of the will altogether or that you have been left an insufficient amount having regard to your relationship with the deceased person.

Certain people defined under the Succession Act 2006 as ‘eligible persons’, have the right to bring a claim for Family Provision Orders in the Supreme Court of New South Wales to remedy the imbalance under the deceased’s Will. There are various categories of eligible persons, some of which need to show a special moral obligation was owed to them by the deceased person.

However, there are many considerations for the Court in deciding whether it should disturb the deceased’s wished as expressed under their last will (or as the law of intestacy dictates if the person died without a Will) and make Family Provision Orders.
