Our client, Mr J, was riding his bicycle to work in a cycling lane next to a major highway, when he came upon a vehicle parked in the breakdown lane. There was minimal passing room between this vehicle and passing traffic. Unfortunately, in trying to pass, our client hit the parked vehicle and was thrown into the traffic lane where he was subsequently run over by a large vehicle. As a result, he suffered life threatening injuries and a permanent spinal cord injury.

Mr J contacted The Law Office of Conrad Curry, whilst in hospital, wanting to know if he had a case against the driver of the large vehicle. Conrad Curry visited Mr J in hospital and, after considering the facts, recommended lodging a claim for personal injury against the driver of the vehicle.

The insurer of the driver denied liability and stated that the injuries suffered by Mr J were the result of his actions and that their client’s vehicle had not struck him.

By engaging experts, and in particular an accident reconstruction expert, we were able to show that the driver of the vehicle had not taken the necessary precautions and that the vehicle had in fact run over Mr J .

A settlement conference was arranged, in an attempt to settle without the need for a Court hearing. During these negotiations, we were successful in obtaining an excellent outcome for our client.
